Privacy Policy

You may have heard about the new General Data Protection Regulation (“GDPR”), that comes into effect May 25, 2018.

Vincent Holland Tours gathers certain types of information about you as part of our operations. This Privacy Policy explains the types of information we gather, what we do with it and how you may correct or change that information.

Vincent Holland Tours collects your information (such as name and e-mail address) when you voluntarily purchase services. This may include e-mail address, , telephone numbers, address and other data needed to provide services to you. We will only require the minimum personal information we need and use it only to provide the services you have requested.

We do not collect aggregate information about overall user activities online and e do not send any newsletters.

Some of the Personal Information we collect is shared with the hotels where you will be staying, tourguides and transportation companies. (e.g., your hotel name for pick-ups and drop-offs, your mobile phone number, etc.)

Terms & Conditions

Vincent Holland Tours is a trading name of Holland Tour Company

Unless otherwise stated, all bookings and purchases made through this website or otherwise are subject to these Terms & Conditions; in all booking arrangements, the person making the booking shall be deemed to have accepted these conditions on behalf of the persons named in the booking.

In these terms, the following definitions shall apply:

  1. Holland Tour Company: The entity Holland Tour Company VOF that offers touristic products and / or services to travelers;
  2. You: The natural person / traveler who uses our services by making a booking / purchase with Holland Tour Company via our website or otherwise, including the persons named in the booking;
  3. Agreement: an agreement / booking between the traveler / you and Holland Tour Company regarding products and / or services, provided by Holland Tour Company;
  4. Cancellation Policy: The policy within which you can cancel the agreement c.q. booking with Holland Tour Company, see our article 17;
  5. Vehicle: any means in or by which you travel or anything is transported or carried.

Applicability of these Terms & Conditions

  1. By using the services of Holland Tour Company and /or our website, you agree to be legally bound by these Terms & Conditions, which shall take effect immediately.
  2. If you do not agree to be legally bound by these Terms & Conditions, please do not access and/or use this website.
  3. When you already have a confirmed booking with Holland Tour Company, we will inform you about the changes in the Terms & Conditions. You’ll have 14 days to agree with the new Terms & Conditions, or cancel the booking / purchase. If you don’t cancel within the 14 days, you are bound by the new Terms & Conditions. When a booking / purchase takes place within 14 days of the effective date of the new Terms & Conditions, the old Terms & Conditions apply.
  4. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use content from this website (including text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of Holland Tour Company content requires the prior written permission of Holland Tour Company.
  5. You agree to use Holland Tour Company and Holland Tour Company-affiliated websites only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of Holland Tour Company.
  6. Your use of Holland Tour Company or any Holland Tour Company-affiliated sites is intended for personal, non-commercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this site to make any speculative, false or fraudulent requests. You agree not to use robots or other automated means to access this site, unless specifically permitted by Holland Tour Company.

Booking and Product Validity, Modifications & Amendments

  1. All products, tours and services offered by Holland Tour Company are valid once the (deposit) payment for the agreement, has been received by Holland Tour Company. Only information provided by Holland Tour Company about products, tours and services is binding; Holland Tour Company is not responsible or liable for any information about products, tours and services, which comes from third parties. Obvious mistakes, spelling or printing errors do not bind Holland Tour Company.
  2. All requests for modifications/amendments must be directed to the Holland Tour Company Customer Care team who will process the request.

8.1 Holland Tour Company does not charge a fee to amend or change the dates of an existing booking, as long as the request is received by our Customer Care team more than eight (8) days ahead of your confirmed travel date and subject to availability. If tickets have been purchased, these cannot be refunded or amended.

8.2 It may not be possible to change or modify a ticket. Sales of tickets are sometimes final and cannot be amended once your original purchase is confirmed. A booking is final once we have received a (deposit) payment from you. You will receive a confirmation from our booking system by email.

8.3 All other date-change requests and amendments are subject to availability by our team and affiliates and/or service providers; Holland Tour Company cannot guarantee the success of any date-change request.

8.4 If you request a date change within eight (8) days or less of your confirmed travel date, Holland Tour Company will attempt to honor your request; however changes made eight (8) days or less from your original travel date may require an additional fee.

8.5 If you make a purchase using a Holland Tour Company discount or special-offer price Holland Tour Company may decide, at its sole discretion, to honor your discount or special-offer pricing if you make a post-purchase change or amendment to your itinerary. However Holland Tour Company reserves the right to invalidate your discount or special-offer pricing if you make any changes to your confirmed itinerary.

  1. Holland Tour Company reserves the right to cancel, change or substitute any service, tour, ticket or product that you have booked at Holland Tour Company or through Holland Tour Company-affiliated websites, at any time, for any reason, without being liable for any damage that may arise therefrom.

9.1 In such cases, if you are dissatisfied with the alternatives offered, you are entitled to a full refund of the original purchase price.

9.2 Notwithstanding the above, when we are informed in advance by our agents, service providers , affiliates and/or suppliers of a significant change to a booking and/or to a tour, product or event, we make every reasonable effort to notify the consumer, travel agent and/or distributor as appropriate, in order to amend or re-issue the booking where feasible.

 

Pricing & Inclusions/Exclusions

  1. Prices listed on Holland Tour Company and Holland Tour Company-affiliated websites are per guide or vehicle, unless otherwise specified.
  2. Prices for tickets on Holland Tour Company and Holland Tour Company-affiliated websites are per person, unless otherwise specified.
  3. Prices are based in Euros, and include VAT as determined by Holland Tour Company.
  4. Price quotations are subject to change without notice, until a booking has been confirmed.
  5. Unless otherwise specified, prices do not include any admission fees.
  6. Prices do not include baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed.

Payments & Cancellations

  1. Holland Tour Company accepts payments via Stripe (this includes most credit cards) and bank transfer or wire transfer.

15.1 To reserve a tour, activity or transfer at least a deposit payment of 20% of the total is required to confirm the service at the time of the booking, unless otherwise stated.*

15.2 Full payment must be received by Holland Tour Company at least 14 days prior to service date by credit card, bank transfer or wire transfer.*

15.3 When SWIFT fees need to be paid, you have to choose OUR: the sender bears all costs.

15.4 All our prices are in euros. Your chosen payment gateway will use an exchange rate to convert the price to your own currency.

15.5 Special tickets, entrance fees, shows, or any ticket of any nature must be pre-paid 100% at the time of booking.

*For groups from 8 pax and up, other terms may apply.

16 No refunds are available once a tour or service has commenced, or in respect of any package, if meals or any other services have already been used.

  1. Cancellation Policy: canceling a booking with Holland Tour Company can result in cancellation fees being applied by Holland Tour Company, as outlined below. Additional fees may be levied by other suppliers if relevant. When cancelling any booking you will need to inform Holland Tour Company through our booking system or by email. 

17.1 Cancellation fee of;
– 100% is charged if cancelled 4 days or less before start of the service.
– 50% is charged if cancelled between 8 and 4 days before start of the service.
– 20% is charged if cancelled between 14 and 8 days before start of the service.
– 0% is charged if cancelled 15 days or more before the event.

For groups from 8 pax and up other conditions may apply and for Special packages other conditions may apply.

17.2 Event, Attraction, Theatre, Show or Entrance tickets may be non-refundable – please ask the Customer Care team in advance.

Passport, Visa, Health requirements & Insurance

  1. It is the responsibility of you and all the persons on the booking, regardless of nationality and destination, to check with the consulate of the country that you are visiting for current entry requirements.
  2. As passport, visa and health requirements are subject to change without notice, we recommend that you verify health, passport and visa requirements with the appropriate consulate prior to departure. Holland Tour Company accepts no liability for missing out on a tour and/or service or product and any damage therefrom, due to noncompliance of passport, visa or health requirements.
  3. We strongly recommend that you purchase a comprehensive Travel Insurance Policy prior to departure. If you cancel your trip or significantly alter travel dates, many policies will reimburse the cost of cancellation fees and related expenses.

Disclaimers & Limitations of Liability

  1. Under no circumstances shall Holland Tour Company or its guides, agents, affiliates, service providers, suppliers, and/or distributors be liable for any direct damage, or any of the following losses or indirect damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of Holland Tour Company regardless of the form of action.
  2. Holland Tour Company and its guides, agents, affiliates and suppliers, in making and executing arrangements for hotels, tours, transportation or any other service in connection with the itineraries of individual customers, shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours.
    Should Holland Tour Company, notwithstanding the exclusions of liability in articles 21, 22 and 23, be obliged to pay compensation for whatever reason, this obligation shall be limited to a maximum of the invoice value of the relevant agreement or booking.
  3. Furthermore, Holland Tour Company and its guides, agents, affiliates and suppliers accept no liability for any damage resulting from unforeseen circumstances (“force majeure”), such as but not limited to sickness of Holland Tour Company or its guides, agents, affiliates, suppliers, contractors etc, pilferage, labor disputes, machinery breakdown, government restrains, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control.
  4. Holland Tour Company’s content – including the information, names, images, pictures, logos, prices, dates, and availability regarding or relating to Holland Tour Company and/or to a Holland Tour Company-affiliated website, service provider, operator and/or distribution partner – is provided “AS IS” and on an “AS AVAILABLE” basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
  5. At Holland Tour Company, we check and recheck the details about all the products and services we offer for accuracy. However, Holland Tour Company does not warrant that functionality, content or information contained on Holland Tour Company or any Holland Tour Company-affiliated website will be uninterrupted or error free, that defects will be corrected, or that Holland Tour Company or the servers that make it available are free of viruses or bugs.
  6. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
  7. You are obliged to comply with all indications and instructions given by or on behalf of Holland Tour Company. You will bear the consequences yourself if you fail to act accordingly and Holland Tour Company has the right to exclude you from (or taking further part of) the agreed service, without being liable for any resulting damage. When any service of Holland Tour Company is executed on a public road, additionally the following obligations and authorities apply to you:

27.1 Within a vehicle you are obliged to:
a.follow all reasonable indications or instructions by guide or driver, such as taking place in the seat indicated by guide or driver;
b. put on a seatbelt before the journey commences.  Any fines or penalty arising from non-compliance with this obligation by you may be recovered from you.
c. open the vehicle door in such a way that it does not form a hindrance and/or danger to traffic. 

27.2 Using or in the vehicle, you shall be obliged to refrain from:
a. damaging and/or soiling the vehicle;
b. consuming alcoholic drinks, unless with the express permission of driver;
c. carrying and/or using drugs/narcotics;
d. using tobacco products;
e. aggressive behavior, physical harassment, other forms of harassment, making threats, or any other improper behavior towards guide or driver and/or others;
f. hindering the guide or driver in any manner whatsoever in the performance of his task.

27.3 When participating in traffic, you are obliged to:
a. follow the laws, applicable in that area;
b. you are obliged to take responsibility over your own safety.

 

Independent Contractor Relationship

  1. You understand, acknowledge and agree that services you have booked with Holland Tour Company can be executed by independent contractors, which are not employees, agents, joint venturers or partners of Holland Tour Company. These independent contractors, act exclusively on their behalf and for their own benefit, and not on behalf, or for the benefit, of Holland Tour Company.
  2. You hereby understand and expressly agree that Holland Tour Company does not direct or control the independent contractor generally or in their performance during the service provided, including, but not limited to, quality, timing, legality or any other aspect whatsoever of the services actually delivered by the independent contractor, nor the integrity, responsibility or any of the actions whatsoever of the independent contractor. 
  3. The independent contractor, and not Holland Tour Company, is responsible for determining, understanding and complying with all laws, rules and regulations that apply to their activity and to the services provided to you.

Applicable law and disputes – loss of claim

  1. All agreements with Holland Tour Company are governed by Dutch Law, even when parts or the full agreement have been performed in a foreign country and even when the counterparty has his residence outside the Netherlands. The relevance of the Viennese Buy treaty is excluded.
  2. In case any disputes might occur, these should be settled in front of the Dutch courts exclusively.
  3. Before calling upon a judge, both parties will make their best efforts to settle their differences between themselves.
  4. Any possible right of claim with respect to Holland Tour Company’s liability will lapse after one year, starting from the moment when the booked service is performed and/or granted.
